Terms and Conditions – Website usage


Welcome to our website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Revolution X Limited relationship with you in relation to this website.

The term ‘Revolution X’ or ‘us’ or ‘we’ refers to the owner of the website whose registered office is 4/29 Crescent St Holroyd NSW 2142. Our company ABN is 15129946167. The term ‘you’ refers to the user or viewer of our website. The use of this website is subject to the following terms of use:

  • The content of the pages of this website is for your general information and use only. It is subject to change without notice.

  • Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. Terms and Conditions – Centre Usage


Revolution X Performance Centre would like to clearly outline the terms and conditions of this engagement as simply and thoroughly as possible. Please take the time to read through the information carefully to avoid any uncertainty. It is important that the terms of the contract between you and Revolution X are clear because the terms in this contract will prevail over all other previous correspondence between Revolution X and you. Failure by us to enforce your rights at anytime for any period shall not be constructed as a waiver of these rights.

Services provided by Revolution X:
 

Note: All membership types include an Induction/Trial Session excluding casual visits.
 

If there is a miscalculation on your membership application or agreement, we have 5 days after the agreement is signed to correct it.

Eligibility and Access

  • You must be at least 18yrs of age to participate in Revolution X this excludes CrossFit Kids.

  • Ages 16+ may be approved by Revolution X Pty Ltd to participate in the FX program entirely at the discretion of Senior Management. Pre-Requisites include a prior training assessment and interview and parent or guardian Consent is required. All membership paperwork requires a guarantor.

  • Children participating in CrossFit Kids under the age of 18 require parent or guardian Consent.

  • You must complete an Induction session prior to participating in you first session and if Revolution X is confident you are fit to train and can perform basic skills and activities you will be welcomed to join our program. If you do not complete an Induction session, Revolution X will not allow you to participate in a session/class.

  • Outdoor training sessions are only cancelled during extreme weather conditions. Training will continue in the rain.

  • You are not permitted to transfer your Revolution X sessions to another person.

  • You will be given an access card when you join. We will also attach a photo to your account on our computer system, if you visit the centre without a valid access card or photo identification, we may refuse you entry.

  • You can not lend your access card to anyone else or allow anyone else to use it.

  • If you lose your card, we will replace it for a nominal fee, currently $10.00.

  • Payments of membership do not depend on how often you use the centre.

  • The use of mobile phones is prohibited on the centre floor unless otherwise approved for use by Revolution X Staff.

  • You must follow the Revolution X Code and the CrossFit Code of Conduct.

  • We reserve the right to refuse entry to anyone, including members. Warnings will be issued if you act in an unreasonable way, break these terms and conditions or centre rules. If you continue to behave the same way, We may cancel your membership immediately. Your membership will be cancelled immediately if you behave in a way that is risky or seriously inappropriate such as; creates a hazard to the health and safety of you, or any others, threatening or harassing others, damaging equipment or using illegal or performance enhancing drugs.

  • Unless there is a very good reason there is no such thing as catch up classes. If you miss a class from your own accord, then that session is lost. You are not permitted to move from group to group under any circumstances.

 

Payments, Late Payments and Refund Entitlements

 

Payments & Late Payments:
Revolution X preferred payment option is via Debit Success. Please refer to Debit Success terms and conditions for further information regarding payments and late payments. All cash payments will be issued a receipt onsite at request and please refer to a staff member of the Revolution X administration team regarding any bank transfers.


Couples rate discount options are intended only for the assistance of families training at Revolution X including but not strictly limited to Marital Status of a couple and is only valid whilst the 2 said primary memberships remain active. Approval of couples rate discounts are made entirely at the discretion of Revolution X. If either of the primary member cancels his or her membership, the other member must then pay for his or her own membership but not at the discounted rate. The primary member’s fees will still be debited from the primary member’s nominated bank account but not at the discounted rate and Revolution X reserves the right to amend the payment amount accordingly despite what is listed on the contractual agreement rate. No membership will be amended to incur any fees greater than the set weekly membership fee with the exception of any debit success fees including but not limited to establishment fees, penalty fees and/or transaction fees.

If fees are not fully paid on the due date, Revolution X holds the right to cancel your membership or suspend your centre access until your payments are up to date.

Upfront Payments:
You have the option of paying 3, 6 or 12 months upfront and for visit packs. Prior to your membership ending you will be notified by Revolution X to discuss renewing your membership. By renewing your membership, you agree to the current membership terms applicable at that time. A 10% -20% discount option is available on all upfront membership terms when paid via cash only. Any EFTPOS, Credit Card or bank transfer payments will incur an additional 5% surcharge added to the total and final amount due.

All fees include goods and service tax (GST). Your fees will change in line with any government GST rate changes.

 

Refunds:
 

Cancellation of upfront memberships will not be refunded, unless you can provide evidence for special circumstances and any refunds will be made upon the Director’s discretion. Otherwise, we do not have to refund money that you have paid to us for any reason.

 

Your Responsibilities

  • Making sure that your account can accept direct debits (your financial institution can confirm this).

  • Making sure there is enough money in your account on the payment day and the following 5 days.

  • Telling us in advance if you are transferring or cancelling your account.

  • Telling us in advance about any changes to your credit card, such as its expiry date or number.

  • Telling us in advance any changes to your personal details such as email, postal address, contact numbers and nominated account details.

  • Please note, creating a payment stop does not waive your liability to pay any membership or associated fees as owed to Revolution X and/or debit success.

Alterations and Cancellations by Revolution X


Every effort will be made to ensure that all sessions run as per the details as per the timetable.  However, Revolution X reserves the right to vary session details (including time, location, format and instructor) or cancel a session entirely if necessary.  Where appropriate, notice of these changes may be made via email, phone including SMS, or in person.

Health and Fitness


You must complete the Revolution X client assessment and consultation prior to participating in your initial/first session.  You undertake to provide Revolution X with true and complete information. Depending on any of the questions you answer YES to Revolution X may request that you seek medical clearance prior to starting any session or before you are able to continue any training with Revolution X.
In the event of any change to your health, or condition that would affect your ability to engage in physical activity or to any answer provided in the questionnaire, you undertake to inform Revolution X prior to the commencement of a session.
In the event of an emergency or should the need otherwise arise, you give Revolution X permission to contact your nominated emergency contact, medical practitioner or therapist.


We may choose to refuse your membership application until either your doctor agrees in writing to your centre exercise program or you show us proof you have received medical advice on an appropriate exercise program.

 

Safety First
You agree that, when present or participating in a Revolution X session, you will be careful, both for yourself and others, and you will comply with the safety regulations and instructions of Revolution X coaches at all times.  If exercising in a public space you will observe all local rules, road rules and local laws. If at any time a Revolution X coach considers that you are jeopardising the safety of yourself or others, then you may be asked to leave the session and you will not be entitled to a refund or a credit for that session. At Revolution X discretion, we may also refuse your participation in future training sessions.


Misconduct, using obscene or profane language or exhibiting behaviour that may cause illness and/or injury or is considered offensive or threatening by clients of Revolution X to coaches or other clients is not tolerated. In these cases Revolution X coaches may ask you to leave the session. It will be at the discretion of the Revolution X Senior Management to allow you to continue with the rest of your sessions or not.


You are responsible for any damage to centre facilities caused by you or your guests through wilful act or negligence.

 

Acknowledgement and Acceptance of Risk
 

You acknowledge that participation in physical activity carries with it a risk of injury or damage to personal property and that you voluntarily undertake to participate in a Revolution X session at your own risk.
You represent and warrant that you have disclosed to us all information about your medical condition and history that you are aware of that relates to your participation in a Revolution X session. You understand that participation in a Revolution X session may involve exercise or activity that you should not undertake if you suffer from any medical condition or have a pre-existing injury. You understand that if you are in doubt as to your fitness to carry out physical activity, it is your responsibility to first obtain medical advice or clearance from your doctor, medical practitioner or therapist.


Vehicles and its content, parked in any car park, or elsewhere while attending Revolution X are left at their own risk and Revolution X will accept no liability for loss or damage.

 

Liability
 

General: To the extent permitted by law, Revolution X excludes all implied terms or warranties, whether statutory or otherwise arising from or in connection with these Terms.


Limitation of liability


If Revolution X fails to provide the services in accordance with these Terms, Revolution X will, at its discretion, re-supply the services or pay the cost of re-supplying the services.


Exclusion of liability


To the extent permitted by law, Revolution X excludes its liability for any loss (direct or indirect) of any person arising from or in connection with these Terms or participation in, or transport to/from, a Revolution X session, including, without limitation, any loss (direct or indirect) arising from or in connection with:

  • Any injury or illness you suffer as a result of any on-going medical condition or a poor standard of health or fitness.

  • Any medical condition, injury or illness which you sustain during any session.

  • Any loss or damage to personal property which you bring into our centre or loss or damage in any session.

  • Any medical condition, injury or illness which you sustain related to any transport supplied by Revolution X.

  • Any damage to or loss of your personal property related to any transport supplied by Revolution X.

  • Any loss or damage you suffer caused by a third party.

  • Any loss or damage you suffer caused by events which neither we or our suppliers could have foreseen or prevented even if we had taken all reasonable care.

Indemnity


Except to the extent of Revolution X training, or a Revolution X employee’s, negligent acts or omissions, you agree to indemnify and hold harmless Revolution X and all its employees from all loss (direct and indirect) for which Revolution X or any of its employees may become liable as a result of any claims or actions which you make or which are made on your behalf due to any loss (direct or indirect) that you may suffer as a result of a breach of these Terms or participating in a session run by Revolution X or relating to any bus transport supplied by Revolution X.

Any claim which you might have as a result of an act or failure by such a contractor or employee will be brought against, and will be the responsibility of, that contractor or employee and not Revolution X. You hereby release, and indemnify and keep indemnifying us for any claim suffered by you as a result of an act or omission by a contract or an employee of Revolution X. We will at all times assist, where possible, to resolve any conflict or issue with contractors and will ensure that relevant qualifications and insurances are kept up to date for all personal trainers.

Changes to these Terms and Conditions


Revolution X reserves the right to change these Terms and Conditions without notice.  Once a customer has successfully registered as a client by accepting the Terms and Conditions the responsibility is upon themselves to maintain an awareness of the current Terms and Conditions of Revolution X.  To enable this, the Terms and Conditions will constantly be available from the Revolution X website.

Revolution X reserves the right at any time to increase the fees to be charged, and will use reasonable endeavours to give written notice to the most current email address you have supplied prior to this occurring.

Revolution X cannot guarantee that we will not need to change, add to or remove rules, conditions of joining, including but not limited to the Terms and Conditions, session times and the services and locations offered by Revolution X from time to time. Any such conditions, deletions or changes will be notified to you in writing or by phone with at least 30 days notice.

 

Dress Code / Attire


You will not be permitted to participate in Revolution X unless you are properly attired.

Properly attired means Rev x clients are to wear suitable clothing (non-offensive) and appropriate enclosed sporting footwear when participating in our exercise groups. It is also paramount that personal hygiene is considered when participating in Revolution X, so it is appreciated that everyone wears deodorant and is aware of their own body odour and please use a clean towel when you use equipment, including exercise mats. Sweat Towels are compulsory for use at Revolution X and we do not undertake to provide or loan any sweat towels to members or guests. It is your responsibility to ensure you are equipped with the appropriate dress/attire including sweat towel at all times at Revolution X.

Cancellation/Changes to Membership

All members are required to provide 14 days written notice to cancel their membership or make any changes. Management reserves the right to review your request and will cancel your membership. You may end your membership at any time, if we tell you we are going to change or add to the original terms and conditions, rules or services and facilities or if we are going to change the fees applicable to your membership which adversely affects you. Proof to this affect may be requested. Where we are in breach of our obligations under your contract and we have not remedied that breech within a reasonable time after you have brought it to our attention in writing, you can end your contact at anytime by giving us 14 days written notice.

You can put your membership on hold if you become subject to medical incapacity or travelling. You are required to give Revolution X 7 day’s written notice where applicable. You must produce supporting documentation to our satisfaction by a qualified medical practitioner certifying that you are permanently sick or if you are travelling a flight Itinerary or proof of ticket purchase is required. There is a $5 hold fee for all members signed with Debit Success please refer to Debit Success terms and conditions. Revolution X agrees to waiver this hold fee on the proviso, that suspension remains within a maximum term of 2 months and where the required 7 day’s written notice period is honoured. It is recommended that you consider any prolonged and pre arranged absences you may have prior to joining the Revolution X Performance Centre.

Promotional


By signing these terms and conditions you consent to Revolution X requesting the use of your image in any promotion or any other material in relation to the business. Please note this is only a request and your permission is necessary.

Revolution X may videotape, audiotape, or photograph you for instructional, educational and promotional purposes without payment of any kind to you and without further notice to you or permission from you on the proviso that you have provided at any stage, permission to Revolution X to do so.

Privacy


In the course of establishing a contract with you and during the term of that contract we will obtain access to certain sections of your personal information (such as information concerning your health).  Revolution X will only use, disclose or deal with such information in accordance with your privacy policy. A full copy of our privacy policy is available in the welcome pack or it can be sent to you on request in writing to members@revolutionx.com.au

I ACKNOWLEDGE AND UNDERSTAND:

  • That Revolution X sessions can be dangerous recreational activities and that by participating in them I am exposed to certain risks.

  • That whilst participating in these sessions and activities:

  • I may be injured*

  • Other persons participating in Revolution X sessions may cause me injury or may damage my property, or I may cause injury to other persons or damage their property.

  • The conditions in which the Revolution X sessions are conducted may vary without warning.

  • I may be injured** as a result of the negligence or breach of contract of Revolution X.

  • I assume the risk of and responsibility for any injury ***resulting from my participation in Revolution X sessions.

  • To the fullest extent permitted by law, I release and indemnify Revolution X against all and any actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to me or my property whether by negligence, breach of contract or in any way whatsoever.

By signing an agreement with Revolution X you are acknowledging and accepting the terms and conditions outlined above.
